The Labour Court recommended that sick leave hours be excluded when calculating supervisors’ 2,248 annualised hours at Bord Na Mona, after which overtime rates apply. It also recommended a one-off €1,000 payment to a supervisor who had previously been led to expect payment for overtime worked during sick leave. The recommendation was signed on 26 October 2004. The Amalgamated Transport and General Workers’ Union argued that excluding sick leave hours could leave supervisors working overtime without pay. Bord Na Mona said those hours were not hours worked and that earlier payments counting them had been made in error. The Court said the agreement was silent on the issue and recommended interpreting it to exclude sick leave hours.
