The Labour Court recommended that Fas and the worker refer his bullying complaint to a Rights Commissioner for investigation and a recommendation. The recommendation was dated 13 October 2004. The part-time general assistant and forklift trainer, represented by the Services Industrial Professional Technical Union, was dissatisfied with Fas’s internal investigation and a later appeal rehearing. The union said earlier events and local management’s role had not been investigated, and that the worker could not comment on responses and statements. Fas said it had investigated the allegations under its bullying policy and exhausted the available procedures. The Court said it could see no justifiable reason to refuse a further appeal to a Rights Commissioner.
