The Labour Court recommended that C & D Foods and the Services Industrial Professional Technical Union address the absence of an appeals procedure in the company’s job-evaluation structure. The recommendation was signed on 25 June 2004. The union sought Grade A1 upgrades for 16 Quality Controllers then on Grade A, arguing their duties and responsibilities had increased. The Court found no valid basis for the grading claim, noting that a job evaluation had been agreed in 1999 and a further 1% increase across job categories was agreed in September 2000 to settle grading issues. It recommended that the parties modify the job-evaluation structure to include an appeals procedure.
