Labour Court recommends specialist review for Athy International Concentrates worker

In 2004, the Labour Court recommended that Athy International Concentrates arrange an assessment by an agreed medical specialist and review a worker's position. Suitable redeployment should be considered if an alternative role could be identified. The recommendation was signed on 21 June 2004. The worker had been off work after an industrial accident. The union sought reinstatement in the occupational injury scheme and comparable work; the company said it had paid him for about two years and had no suitable alternative job. The Court said paid sick leave need not be extended and that the available medical evidence said the worker could not safely perform the former job.
