The Labour Court recommended that Technology Sales Leads Ltd pay €2,500 to a worker whose probationary dismissal it found unfair. The recommendation, dated 11 November 2003, said the employer’s failure to follow procedures prescribed by the statutory code of practice rendered the dismissal unfair. The worker, employed as a senior business leads provider, said he was put under unreasonable pressure over call targets and dismissed without warnings or proper procedures. The company said his performance was unsatisfactory despite management support and training. The Court said being on probation did not remove the employer’s duty to act fairly.
