Labour Court recommends further three months’ salary for Lidl worker after unfair dismissal

The Labour Court found that Lidl Ireland GmbH had constructively dismissed a maintenance operator and failed to follow fair procedures. It recommended additional compensation equal to a further three months’ salary, dated 11 November 2003, in full and final settlement of claims arising from the termination. The worker had already received three months’ salary.

The worker said his hours and van use changed after a new contracts manager was appointed, and that twice-daily reporting made it difficult to complete his duties. Lidl said it introduced reporting requirements after complaints about unfinished work and gave him verbal and written warnings. The Court found it had decided to end the employment relationship before meeting with him and had not followed fair procedures over the alleged performance shortcomings or an earlier warning.
