The Labour Court recommended that John Casey Limited pay a worker €20,000 in compensation after finding that her dismissal was grossly unfair. The recommendation was signed on 20 October 2003.
The worker said she was dismissed without warning or representation and had not received commission and a promised Christmas bonus. The company said her probation was extended because of performance concerns, that it had paid her entitlements, and that it had not promised a bonus.
The Court found no evidence that she had been told of the performance concerns or that her probation had been extended. It considered it unfair to withhold commission because she had left, and found the way she was dismissed totally unsatisfactory and unfair.
