The Labour Court recommended that Bio Medical Research (BMR) improve its redundancy offer to 3.75 weeks’ pay per year of service, including statutory redundancy, without a cap. The recommendation was signed on 18 September 2003 and concerned 43 workers affected by the closure of the company’s Donegal plant. The Services Industrial Professional Technical Union sought 2.5 weeks’ pay per year of service plus statutory entitlements, without a cap. BMR said it could not increase its offer because of accumulated losses. The Court said the earlier terms had been offered voluntarily or under last-in, first-out selection, while the remaining redundancies would be compulsory because the plant was closing.
