The Labour Court recommended that the North Eastern Health Board offer an unnamed consultant the opportunity to use an agreed formula for accumulated rest days. The recommendation was dated 17 September 2003. The Irish Medical Organisation sought payment for work it said exceeded the consultant’s contractual obligations from 1972 to 1999, including accumulated rest days, cross-cover and paediatric work. The Board disputed the claims and said the consultant had declined the 1998 contract. The Court considered a formula agreed in 1997 the most appropriate mechanism for accumulated rest days and recommended the Board make the offer without delay.
