The Labour Court recommended that Tipperary Mushrooms concede a union claim for 16 workers’ second-phase 5.5% and third-phase 4% payments under the Programme for Prosperity and Fairness, including retrospection. The recommendation was dated 15 September 2003. The Services Industrial Professional Technical Union said the payments and retrospection were due. The company sought a deferral because senior management was unavailable but made no substantive submission or financial case at the hearing. The Court found the employer had adequate notice and had not substantiated an inability to pay.
