The Labour Court recommended an ex gratia retirement payment for five part-time staff at the Regional Medical Library, or pension benefits arising from implementation of the Protection of Employees (Part-Time Work) Act, 2001, whichever is greater. The recommendation was dated 9 June 2003. Amicus MSF sought a retirement gratuity for the staff, whose library service was funded by the Mid Western Health Board. The University Of Limerick said no gratuity provision existed and the staff were not eligible for its pension scheme. The Court noted that comparable long-serving Health Board employees without pension coverage were entitled to a gratuity.
