In 2003, the Labour Court recommended that Roches Stores (Henry Street) calculate the 1% Programme for Prosperity and Fairness lump sum using each worker’s basic weekly pay rate on 1 April 2002, multiplied by 52. The recommendation was signed on 12 May 2003. The Court said basic pay did not include commission or overtime. Display staff plus payments were not reckonable; whether those payments should be consolidated into the basic rate was outside the referral. Mandate argued the calculation should reflect annual basic pay and sales staff commission earnings, while the company argued the PPF specified basic pay only.
