The Labour Court recommended that Premier Periclase pay the third phase of the Programme for Prosperity and Fairness increase from 1 January 2003, in a recommendation signed on 3 March 2003. It said the parties should discuss arrears in light of the company's financial circumstances. The Services Industrial Professional Technical Union, Amalgamated Transport and General Workers' Union and Technical, Engineering and Electrical Union had sought payment from April 2002. Premier Periclase said losses and forecasts made the increase unaffordable. The Court accepted the company would have difficulty paying, but did not consider this an inability to pay.
