In 2003, the Labour Court recommended that Nui (Galway) honour its agreement to recognise a €7,618 allowance in an associate professor’s salary, particularly for pension purposes. The recommendation was signed on 21 February 2003. The Irish Medical Organisation said the university had agreed in 2000 to make the allowance pensionable, then reversed its decision. Nui (Galway) said it had made the undertaking without knowing that pension rules and university statutes prevented the allowance from being incorporated into basic salary without changes. The Court considered the reversal grossly unfair in the case’s unique circumstances and recommended that the adjustment take effect from 1 July 2000. It also recommended that the claimant continue to carry out the duties required by the post.
