The Labour Court recommended that employees at St Raphael's Centre continue working as management requested while the Southern Health Board recruited four people and sought approval for the remaining posts. The recommendation was signed on 5 February 2003. The Services Industrial Professional Technical Union and the Irish Municipal, Public and Civil Trade Union said an agreement to introduce a dedicated Care Assistant grade had not been honoured. Management cited budget and staffing constraints. The Court noted employees were already paid the Care Assistant rate and found management's proposal to recruit four people while seeking approval for the rest reasonable. It recommended reviewing the situation on 1 January 2004.
