The Labour Court recommended that Nestle Ireland Limited continue discussions with the Amalgamated Transport and General Workers’ Union and the Services Industrial Professional Technical Union over a loyalty payment. The recommendation was dated 29 November 2002. Nestle had sold its Tallaght plant to Fruitfield Foods after announcing plans to cease production in Ireland. The unions said the company had discussed a loyalty payment but later refused to pay it. Nestle did not attend the hearing. The Court found that an employer-employee relationship existed when the issue was raised and recommended continuing discussions.
