The Labour Court recommended that Coca Cola Bottlers Ireland offer a bottle-sorting chargehand suitable alternative employment within three months or agree redundancy terms with the Services Industrial Professional Technical Union. Its recommendation was signed on 28 November 2002. The dispute followed the company’s decision to contract out bottle sorting and move the worker back to shift work. The Court found the alternative jobs offered were not comparable to his former position. It also highlighted the employer’s duty of care to investigate reports about colleagues’ behaviour.
