The Labour Court recommended that Cadbury Ireland Ltd recover excess double-time payments made to two shift operators for weekend training and donate the amount to a charity nominated by the unions. The recommendation was signed on 11 October 2002 and set a four-pay-week period for recovery. The company had agreed to pay double time during the training as a temporary arrangement, then sought to reclaim the excess over the agreed overtime rates. The Court found the company’s position on the applicable rate correct and said the excess was recoverable. The two unions named in the case were the Services Industrial Professional Technical Union and the Amalgamated Transport and General Workers’ Union.
