The Labour Court recommended that St Michael's House give care assistants time off in lieu within the same four-week roster period as overtime worked, or pay overtime at the end of that period. It did not recommend the union's claim for overtime rates as presented. The Services Industrial Professional Technical Union sought overtime rates for non-nursing staff. St Michael's House said it had relief staff to cover absences and that extra hours were compensated with time off in lieu. The Court said the employer's approach was in line with arrangements at similar agencies. Its recommendation was dated 5 September 2002.
