The Labour Court recommended a €13,000 payment to an Iarnrod Eireann locomotive driver after finding that a prolonged disciplinary process caused him additional distress and anxiety. The recommendation was signed on 4 July 2002.
The Court could not say that the dismissal itself was unfair. The worker accepted that his serious misconduct would normally justify dismissal, and the Court said he bore major responsibility for the delay because he was unwilling to consider representation by a colleague in his own district. It recommended the payment in full and final settlement of his claim.
