The Labour Court recommended that trustees consider increasing the pension benefits of a worker who retired from Bayer Diagnostics Manufacturing Limited in 2001. The recommendation, dated 15 April 2002, followed a dispute brought by the Amalgamated Engineering And Electrical Union over how his pension was calculated. The Court said the pension booklet could reasonably lead a worker retiring after January to understand that salary increases since January would count in the calculation. It found the scheme rules did not specify the applicable salary date for retirement before normal pension age, and noted the company intended to issue a revised booklet.
