In 2002, the Labour Court recommended that Arcon Mines Limited offer partial compensation to craft workers over an incentive scheme that initially failed to meet expectations. The recommendation was dated 3 January 2002. The Technical, Engineering And Electrical Union said the scheme failed to deliver the expected 12.5% and that national agreements should apply. Arcon Mines Limited said 12.5% was the scheme’s potential, not a guarantee, and that a pay agreement remained in force. The Court did not recommend conceding the claim on national agreements. It said it would make a definitive recommendation on compensation if the parties could not agree.
