The Labour Court said six weeks’ compensation was unreasonable for a maintenance electrician transferred from evening to day shifts at Donegal Healthcare and recommended that the company and the Amalgamated Engineering And Electrical Union meet to agree a satisfactory figure. The recommendation was signed on 19 October 2001. The employee had worked shifts for about 10 years and had received six weeks’ shift premium after his transfer. The union sought 18 months’ compensation. The company said six weeks had been its practice and offered him the option of returning to evening shifts, which he declined. The Court said the formula had been applied inconsistently and could make a definitive recommendation if the parties could not agree and requested one.
