In 2001, the Labour Court recommended that Aer Lingus give Sean Brazil Grade C on a personal basis, backdated to 1 June 1999, after a dispute over his promotion. Brazil had acted as a Grade C supervisor from December 1997 to December 1999. The Services Industrial Professional Technical Union said the Operative Grades Agreement entitled him to the promotion. Aer Lingus said it had not filled the vacancy because of uncertainty over its TEAM/FLS Aerospace contract, and that Brazil performed only a contact role while others carried out many supervisory duties. The recommendation, signed on 21 June 2001, says he would progress within the supervisory scale only through national pay agreements unless promoted to a supervisory role.
