The Labour Court recommended that Shamrock Aluminium Ltd concede a claim for holiday pay based on rostered overtime worked by four employees. The recommendation, dated 22 January 2001, followed a dispute with the Services Industrial Professional Technical Union. The union said the workers had performed mandatory weekend overtime for years, but the company had excluded average overtime from holiday pay calculations. The company said the overtime was not regular or rostered, although it was prepared to include qualifying overtime in future. The Court considered the amounts claimed reasonable and recommended that they be conceded. It said the claim was expressed net and should be regarded as gross, with statutory deductions a matter for the Revenue Commissioners.
