Labour Court recommends £250 and reference after McLaughlin Components dismissal

The Labour Court recommended that McLaughlin Components Limited pay £250 compensation and provide a satisfactory reference to a worker whose dismissal procedures it found unfair. The recommendation was signed on 27 October 2000. The worker said problems began after she complained about her wages, raised safety concerns and declined overtime. The company said it extended her probation over performance and attitude, then dismissed her as unsuitable. The Court noted there was no evidence of unsatisfactory performance and that she had not been properly counselled. It also noted that she withdrew consent to overtime contrary to her contract, but found that dismissing her over the phone was unfair.
