The Labour Court found that a driver’s dismissal by Flynn Brothers Rent-A-Car (Ballygar) Limited, trading as Budget Car Rental, was unfair and recommended £1,000 compensation and a suitable reference in a recommendation dated 20 October 2000.
The worker said he was dismissed because he was from Ballymun after three cars were stolen from the company’s compound. The company denied this and said staffing levels were too high. It argued that a £285 payment agreed at the Employment Appeals Tribunal had settled the dispute, but the Court found the worker had not agreed that the payment covered his unfair dismissal claim.
The Court said the company had provided no evidence to support its reasons for selecting the worker for dismissal or to show there had been complaints about his performance. It also noted that he had no employment contract and the company had no grievance or disciplinary procedures.
