The Labour Court found that a worker transferred to An Bord Pleanala retained the added-years benefit under Circular 11/85, but was not automatically entitled to later changes for civil servants under Circular 12/97. The recommendation was dated 17 October 2000. The Irish Municipal, Public And Civil Trade Union sought the improved Circular 12/97 arrangements for An Bord Pleanala inspectors, arguing they had a traditional link with civil service pay and conditions. The Board said the worker had transferred in 1984 and retained the terms he had then. The Court said only employees seconded from the civil service retained the right to the improved benefit.
