The Labour Court found that Itm Dublin had not unfairly dismissed a worker during a six-month probationary period. The recommendation was signed on 25 August 2000. The worker said the dismissal followed his return after illness and that the company had not followed proper procedures. Itm Dublin said it dismissed him over poor attendance and time-keeping, despite warnings and opportunities to improve. The Court found that the company had clearly communicated appropriate disciplinary procedures and applied them fairly. The unfair-dismissal claim failed.
