The Labour Court did not recommend an ex-gratia payment sought by Mandate for about 15 workers who transferred to Capital Bars PLC after a merger. Its recommendation was signed on 24 August 2000. Mandate sought financial recognition for the workers’ contribution, saying they had previously forgone bonuses and wage increases during the group’s trading difficulties. Capital Bars said it had met its legal obligations and that the transaction was a merger, not a sale. The Court noted there had been no material change in beneficial ownership and said it knew of no similar precedent for an ex-gratia payment. It did not recommend concession of the claim.
