In 1999, the Labour Court recommended changes to Irish Distillers Limited’s profit-share scheme after finding that inadequate communication about changes to its scope had led to the dispute. The Services Industrial Professional Technical Union, Manufacturing, Science, Finance, Amalgamated Engineering and Electrical Union, and Technical, Engineering and Electrical Union had challenged the inclusion of directors and employees of companies outside the original scheme. The Court recommended defining excluded directors by reference to the Companies Act and expressly including staff of two disputed subsidiaries retrospectively. It recommended no change to the established profit calculation method and called for transparent monitoring arrangements. The recommendation was dated 2 July 1999.
