In 1998, the Labour Court recommended that Avery Berkel not concede the Technical, Engineering And Electrical Union’s claim to include a company car benefit in a redundancy calculation. The dispute concerned one of four workers made redundant in 1997; his package was £24,671. The union argued the package had been set without employee input and that a £300 ceiling should not apply to the benefit in the company lump sum. Avery Berkel said its standard package excluded the benefit and that the non-statutory payment was for the company to determine. The Court signed its recommendation on 20 November 1998.
