The Labour Court recommended on 22 June 1998 that Bord Gais Eireann backdate pay regrading for two engineers to three months after the agreed date each claim was served: October 1993 for one worker and October 1994 for the other. Manufacturing, Science, Finance sought retrospection to 1991 and 1993, saying the company had delayed processing the claims despite repeated requests. The company argued that its usual practice was to apply regrading from one month after an official claim. The Court found the company had caused unwarranted delay, while noting that the workers had also been somewhat lethargic in pursuing the matter. It said up to three months should have been enough time for the company to assess each claim.
