In 1998, the Labour Court recommended that Thermo-King Europe Limited and the Amalgamated Engineering And Electrical Union address a dispute over how their agreement applied to management instructions during grievances. The recommendation was signed on 19 June. The union said normal working should continue while grievance procedures were followed; the company said workers should carry out lawful and safe instructions and raise grievances through the agreed process. The Court said it was difficult to define “normal working” and “the status quo” and recommended that the parties seek an accommodation. It said it would issue a definitive recommendation if discussions failed and a party requested one.
