In 1996, the Labour Court recommended that Tayto Limited pay a worker a sum equivalent to twice his actual commission loss after a sales-route reorganisation. The recommendation was dated 24 October 1996. It also called for a review of his route and its earning potential, followed by monitoring after 12 months. Services Industrial Professional Technical Union said the driver had lost commission despite an understanding that no driver would suffer a financial loss. Tayto said commission varied between routes and the worker’s gross weekly earnings had increased since 1991. The Court found there had been an expectation that earnings would be at least in line with those on the old route by September 1996.
