In 1996, the Labour Court recommended against conceding MSF’s claim to promote a research officer from Principal Research Officer to Senior Principal Research Officer at Teagasc. The Court, in a recommendation dated 12 March 1996, said granting the claim would bypass normal promotion procedures. MSF argued the employee’s qualifications, experience and research publications supported promotion, and alleged discrimination based on age, trade union activity and previous employment at An Foras Taluntais. Teagasc said it used its usual criteria and the employee did not rank high enough. The Court urged the parties to agree an appeals process for future vacancies.
