In 1995, the Labour Court found that Richard Gernon unfairly dismissed a shop assistant and recommended that she receive one week’s pay in lieu of notice, holiday pay due and a P45. The recommendation was signed on 3 October 1995. The worker said she had no warning before being dismissed after allegations about till discrepancies. Richard Gernon did not take part in the hearing. The Court found there were no grounds for the employer’s allegations and that the worker had not been given an opportunity to answer them. It also found she had not received notice or holiday pay due and recommended the specified remedies.
