In 1995, the Labour Court recommended pro-rata transport-section payments for six Cadbury Ireland Limited employees: four utility workers, one spare worker and one seasonal worker. The recommendation was signed on 28 July 1995. The Services Industrial Professional Technical Union and the Amalgamated Transport and General Workers Union sought compensation for 25 dispatch workers after Cadbury proposed contracting out transport, warehousing and distribution. The unions argued the workers would lose earnings and that some warehouse-designated staff had performed driving duties. The Court said warehouse staff were covered by the overall joint negotiating body and their transfer to production was within the mobility agreement. It found that some warehouse employees had spent a significant part of their time in the transport section, and recommended pro-rata transport terms for those six workers. It considered the earlier driver settlement specific to that group's pay structure.
