In 1995, the Labour Court found that Tullamore Casings had not implemented Phase 3 of the PESP agreement as agreed with the Services Industrial Professional Technical Union. It recommended retrospective adjustments for overtime, shift premiums and pension credits based on a £5.75 weekly increase from April 1993, and implementation of Phase 3 from 1 April 1995. The recommendation was signed on 4 May 1995. The company said a piece-rate system had been agreed in place of Phase 3 and had yielded greater payments. The Court found the bonus scheme had not been advised to or agreed with the union, or set out in a written agreement with the workforce, although it had generated greater payments. The Court also recommended a meeting to review the bonus scheme alongside the increase.
