In 1995, the Labour Court did not recommend conceding the Technical Engineering And Electrical Union's claim that shift premiums for electricians at Irish Fertilizer Industries be included in pension calculations. The company argued the electricians were day workers and that scheme rules excluded variable employment and overtime. The Court found the shifts were regular, rostered and compulsory, and considered the union's claim to have merit. It said conceding the claim at the time would conflict with the Programme for Competitiveness and Work and recommended that the parties address the financial implications of extending benefits. The recommendation was signed on 21 March 1995.
