In 1995, the Labour Court recommended that Micromotors Groschopp (Ireland) Limited implement the first phase of the Programme for Competitiveness and Work (PCW) with effect from 1 February 1994. The recommendation was signed on 3 January 1995. The Services Industrial Professional Technical Union sought increases under the PCW and the Programme for Economic and Social Progress (PESP) on behalf of 95 workers. The union said workers had improved efficiency and productivity, while the company cited trading difficulties, lay-offs and short-time working. The Court considered it inappropriate at that time to pursue the separate PESP Clause 3 claim because of the company's difficulties.
