In 1994, the Labour Court found no grounds to recommend a 3% increase for 41 workers at Ross Products Limited under Clause 3 of the Programme for Economic and Social Progress. The recommendation was signed on 6 May 1994. The claim was made by the Services Industrial Professional Technical Union on behalf of the workers. The company, a voluntary organisation running a sheltered workshop, argued it was loss-making and that conceding the increase would threaten its employment objective. The Court left the parties free to negotiate recognition of the clause on a quid pro quo basis, but said it saw no other basis to recommend the claim without mutual agreement.
