In 1992, the Labour Court recommended that a worker dismissed by Silvercrest Foods during probation had not been unfairly dismissed. The recommendation was dated 29 October 1992. The worker missed a Saturday shift and was dismissed the following Monday. He said he had an exemplary work and attendance record and could not attend because his mother was ill and he needed to care for his siblings. Silvercrest Foods said his absence caused operating difficulties during a busy period and declined to attend the hearing. The Court based its recommendation on the worker being within his probationary period.
