In 1992, the Labour Court recommended that Leaf Ireland Limited increase Mrs Sheerin’s redundancy payment from £5,000 to £7,000. The decision was signed on 21 October 1992. The union, Manufacturing Science Finance, had appealed a Rights Commissioner’s recommendation that claims for enhanced redundancy payments fail. Four of eight workers declared redundant in April 1992 sought payments based on earlier company packages. The union argued that a formula of five weeks’ pay per year of service plus statutory entitlements should apply. Leaf Ireland Limited said continued losses and a fixed budget prevented increased settlements. The Court left the Rights Commissioner’s recommendation unchanged except for Mrs Sheerin’s payment.
