In 1992, the Labour Court recommended that Dublin County Council review a driver’s attendance record in January 1993 and consider restoring him fully to its sick-pay scheme if his attendance had continued to improve. The recommendation was dated 16 October 1992.
The worker sought restoration to the scheme and compensation after the Council withdrew his benefit. The Court said the Council’s position was not unreasonable and noted its undertaking to restore him to the scheme if he had a serious certified illness.
