In its recommendation dated 16 October 1992, the Labour Court said Mount Carmel Hospital had acted incorrectly by barring staff from joining its pension scheme. It recommended that the hospital and the Services Industrial Professional Technical Union ask staff about their interest in joining, then discuss the cost of opening membership. The union sought access for about 40 household and catering staff. Management said the hospital could not afford to reopen membership at the time. The Court noted uncertainty about how many staff would join and the financial constraints facing the hospital.
