The Labour Court recommended that Bus Eireann make a £175 ex gratia payment to a driver after he successfully appealed a District Court conviction for driving without due care and attention. The recommendation was dated 16 October 1992.
The National Bus And Rail Union had sought repayment of the driver’s £338.80 legal fees. The Court said Bus Eireann’s policy of not defending driving prosecutions was reasonable, but the circumstances were unusual: the driver had been adjudged blameless after incurring considerable expense. It said the company was not responsible for his loss, but recommended a sympathetic response without changing its policy.
