In its recommendation dated 12 October 1992, the Labour Court rejected the Services Industrial Professional Technical Union’s claim that Irish Industrial Gases use its staff to scrap cylinders in a replacement programme. The programme involved replacing about 18,000 cylinders. The Court found that the work could not be done safely or satisfactorily without seriously disrupting normal production. It also noted that the staff concerned were not losing work or earnings.
