In 1992, the Labour Court supported Greencore PLC’s interpretation of its sickness benefit scheme and did not recommend payment to the worker at the centre of the dispute. The recommendation was dated 13 May 1992. The Services Industrial Professional Technical Union argued that the scheme did not allow the company doctor to overrule another doctor and sought two weeks’ payment. Greencore PLC said its doctor had a distinct role under the scheme. The Court found the company doctor’s opinion determined whether the worker qualified for scheme payments.
