Labour Court recommends excluding sick days from Bus Eireann holiday-pay calculation

In 1992, the Labour Court recommended that a week containing sick days be left out when calculating holiday pay for a worker represented by the National Bus And Rail Union at Bus Eireann. It said the calculation should reasonably reflect the worker's weekly wages over the previous 13 weeks, and found no grounds to exclude public holidays. The recommendation was signed on 4 May 1992. The union said the driver, who worked at Bus Eireann's Sligo Depot, received £10 less for one day's annual leave than if he had worked his board. The company argued regular rostered overtime had to be worked to count towards holiday pay and that changing the method would add costs. The Court recommended using the 12 weeks outside the week in which sick days occurred.
